The EPA requires SPCC Plans on any facility with a capacity of 1,320 gallons or more. SPCC Plans stay valid for a term of 5 years. THE RULE

The Environmental Protection Agency’s Oil Pollution Prevention Rule became effective on January 10, 1974. Find the regulation at 40 CFR Part 112.

Facilities subject to the rule must prepare and implement a plan to prevent any discharge of oil into or upon navigable waters of the United States or adjoining shorelines.

The Plan is called a Spill Prevention, Control, and Countermeasure (SPCC) Plan.

SPCC Plan Implementation

Although many in the industry believe that having an SPCC Plan established satisfies the EPA requirements, this is not truly the case.  In order to stay within compliance regulations with the EPA, you must implement the SPCC plan.  Implementation includes yearly inspections and performing the required SPCC training for all oil-handling employees and contract pumpers.

Additionally, the state requires, before March 1st of each year, that companies satisfy and submit the Tier II state form.  In some circumstances, we have observed EPA agents requesting Tier II reports during an EPA audit.
